Studio hire terms and conditions

Booking and Payment

Your booking time includes your pack up and pack down time. Please ensure that you book the right amount of time to allow for this. The studio must be left in the same condition/ state that it was when you arrived.

Please ensure that you arrive on time to your booking and finish on time as to not interfere with other bookings in the day. Additional time can be arranged at $75+gst per hour. This must be arranged and approved by contacting Mindful Creatives on 0422 591 085 or via email hello@mindfulcreatives.com.au. The additional time will be invoiced and expected to be paid on the day of your booking.

You are free to move around furniture, props, backdrops etc during your shoot time. This must all be returned to a neat and clean state upon the completion of your hire time. Dragging items on flooring is not allowed under any circumstance. If moving props, furniture, backdrops etc you must lift to move.

All items in the studio are thoroughly checked before and after each booking. If any items are deemed to be damaged after a booking, you will be contacted to discuss steps forward to arranging repairs/ replacement.

The hirer is solely responsible for any damage made to any items within the studio or to the studio during the hire time.

The studio is the primary workplace for Mindful Creatives employees. During your hire time, you will have sole access to the studio, however there are certain areas that are forbidden to access. These include, employee desks, computers, locked cabinets and any areas marked ‘do not touch’.

Your booking must be paid for via our booking scheduler. Your booking is not secured until full payment has been made.

If background paper is used and damaged, creased, stained or deemed unfit for future use (at Mindful Creatives discretion), the hirer will be charged $50 per linear metre, due and payable within 7 days.

Hire purpose

Mindful Creatives reserve the right to refuse hire or stop hire if the purpose of hire is in breach of the terms and conditions.

Under no circumstances are pornographic, unlawful underaged activity, illegal acts, the sale or distribution of alcohol or illicit drugs allowed to be undertaken during your booking.

The filming of music video content or any content that contributes to loud noise pollution is not allowed in the studio.

Boudoir photography is allowed, however please be aware that there are security cameras fixed and in use during all sessions, and the studio has large windows where the general public can view inside. We suggest inspecting the space before hire to ensure it is suitable for your shoot. If shooting boudoir, please be mindful of the general public and be discreet in order to not upset or offend.

Cancellation policy

We 100% understand that plans can change, and we want to make it easy for you to reschedule or cancel your booking if need be. If you do need to make changes, please note the following:

Cancellations made with 48 hours or more notice will either receive a full refund or have their full booking fee transferred to your new preferred date.

Cancellations made within 48 hours with no re-booking request are not eligible for a refund. Reschedule requests made within 48 are subject to a $50+gst admin, re-booking fee. No shows are not eligible for a refund. If you are running late for your booking, please let us know ASAP and we will do our best to accommodate you. For hirers running more than 15 minutes late, Mindful Creatives reserves the right to cancel the booking with no refund.

Mindful Creatives reserve the right to refuse booking requests from repeat offenders.

If you do need to reschedule your booking, and have given 48 hours or more notice, your booking fee is valid for 3 months. If a new booking is not made within this time, your forfeit your booking fee and will need to pay again.

Damage and Loss

Use of our studio and our equipment is at the hirer’s own risk. Mindful Creatives is not liable for any loss or damage to person or personal belongings and hereby waives rights to seek legal redress for mishaps, accidents, injury, and/or loss while on our premises.

The hirer is also solely responsible for the safety and well-being of any individuals, third-party contractors or equivalent that they bring onsite to the studio or act on behalf of the hirer during their hire time.

The hirer must have suitable insurance to cover themselves, equipment and any other people acting with or on behalf of the hirer during their booking time.

Any damage made to Mindful Creatives equipment or studio during the time of the hirers booking is at the expensive of the hirer. Security cameras are fitted within the studio to protect the hirer and Mindful Creatives.

In no circumstance is pornographic, unlawful underage or any form of illegal activity allowed to take place during hire time. Mindful Creatives reserves the right to refuse hire, immediately stop a session or report illegal acts to the police.

Indemnity and Liability

The hirer is responsible for their own personal and property insurance. This insurance must cover any third-party contractor, and or people acting with or on behalf of the hirer along with their equipment during the time of their hire.

The Hirer agrees to indemnify Mindful Creatives against any costs including legal costs, damages, payments, fines, or interests Mindful Creatives may incur because of the Hirer breaching this agreement.

Mindful Creatives is not liable for acts out of its control that affect the shoot during your hire time, such as power outages, weather or emergencies. In such cases, Mindful Creatives may refund a portion of Hirer’s payment and/or reschedule the studio booking, this is however, up to the discretion of Mindful Creatives

Mindful Creatives reserves the right to terminate this agreement at any time with or without notice if the Hirer has breached any terms of this agreement or for unforeseeable circumstances that prevent Hirer from fulfilling the agreement.

Video Production

If filming, it is recommended to use photography or natural lighting and not the studio hard wired lighting to prevent flicker. Sound recording is achievable but not guaranteed to be of any standard. We recommend you inspect the studio to determine suitability.

Housekeeping

Please be mindful and respectful of adjoining businesses and residential properties who reside nearby. Excessive noise is not allowed at any time.  Minors must be always supervised. No smoking is allowed in any part of the studio. Our space is a shared working space, please be respectful of employee’s spaces and do not touch the desks or items on the desks during your time.

WIFI is available for general web browsing. Downloading movies, music or restricted content is not allowed.

Alcohol is not to be served or sold.

There is ample free parking available outside of the studio, please be mindful and respectful of neighbouring businesses and the public. Vehicles must not be parked in such a way that causes access issues for others. At no point in time can there be any restrictions made to the public walkway – this must always be clear. If any member of the public is injured or caused harm because of obstructions made by the hirer, then this incident must be dealt with under the hirers insurance. Mindful Creatives takes no responsibility for such acts.

Default

An account is considered in default if it is unpaid for 30 days from the due date. Mindful Creatives reserves the right to refuse access to the studio and its equipment until the outstanding amount is paid in full.

Clients whose accounts are in default agree to pay Mindful Creatives reasonable legal expenses and third-party collection agency fees in respect of the enforcement of these terms of business.

Advertising

We love to share all the exciting things that happen within our walls. By booking with Mindful Creatives, you give us permission to use any photographs or videos taken during your studio time for the purpose of advertising and promotion. If you do not want your images or videos to be used, please let us know before your session.
